Terms of Service

Version 2.0 · effective from 1 September 2026

This is the contract between you and the operator of the game Kokume. It describes what you can expect from the game, what you may and may not do in it, how moderation works and how either of us can end the arrangement.

The game is free and has no purchases. You can delete your account at any time and without giving a reason — in the game under Settings, or through the form on the website. How we handle your data is described in the privacy policy.

The text is written as plainly as we could manage. Nothing in it takes away the rights the law gives you as a consumer.

Who operates the game

The game Kokume and the related website are operated by:

In the text below we appear as “we” or “the operator”, and you as “the player”. The service means the Kokume mobile game, the game servers and the website www.kokume.eu.

What Kokume is and what you need for it

Kokume is a mobile game for Android in which you conquer territory, put up buildings and fight other players by moving around the real map. The game state is stored on our servers, so the game works only with an internet connection.

The game is provided entirely free of charge. It contains no in-app purchases, no paid currency and no advertising. The cost of your data connection and battery consumption is yours to bear; with GPS active, the game uses noticeably more power than an ordinary app.

For the game to work, you need:

On devices that do not meet these requirements we cannot guarantee that the game will work. The game runs in an environment we do not control — GPS accuracy depends on your phone's hardware and on the buildings around you.

Player age

Only a person over 16 may play. By registering you confirm that you meet this condition.

If we find that an account is used by a younger person, we will close the account and delete the data. The limit of 16 corresponds to the highest age for giving consent to data processing on one's own in the countries where we offer the game.

How the contract comes about

The contract between us comes about the moment you complete the registration — you fill in an email and a password, tick the box agreeing to these terms and submit the form. Before submitting you can review and correct what you entered; after registration your email can be changed on request.

We store the wording of the terms you agreed to, together with the date and time of that agreement, so that we can show what we agreed on. We will email you a confirmation of the contract including a link to these terms. The contract is concluded in Czech or in English, depending on the language you use the game in.

The contract is concluded for an indefinite period.

Right to withdraw within 14 days

Because you are entering into the contract at a distance, you have the right to withdraw from it within 14 days of the day it was concluded, without giving a reason and without any penalty. The service is free of charge, so withdrawing puts you under no obligation to pay or return anything.

To withdraw, any unambiguous statement sent to info@kokume.eu is enough. You may use this model form, but you do not have to:

We will action the withdrawal by deleting the account and all data connected with it. Independently of this right, you can close the account yourself at any time later — with no notice period, no reason and no fee whatsoever.

Your account

Rules of play and of content

In the game you create content that others see — your hero name, messages in the faction chat, player reports. These rules apply to such content and to your behaviour in the game alike. It is forbidden to:

If you find a bug, please report it to info@kokume.eu. We punish nobody for reporting a bug, not even a player who used it by accident.

Moderation and measures

When someone breaks the rules or the law, we may, depending on the severity, reach for one of these measures: deleting the offending message or changing an inappropriate hero name, a temporary chat mute, hiding the player from the public leaderboard, a temporary account block or closing the account.

The following applies to how we moderate:

We impose measures diligently, objectively and proportionately to the severity of the breach, with regard to your rights including freedom of expression.

Reporting illegal content

If you come across content in the game that you consider illegal, let us know. Anyone can submit a notice, including someone who does not play the game — an email to info@kokume.eu with the subject “Content report” is enough. Players can also use the report button directly in the game.

So that the notice can be dealt with, please include:

We will confirm receipt of the notice without undue delay. We will assess the notice in a timely, diligent and impartial manner and inform you of the outcome and of the remedies available. If we find a suspicion of a criminal offence threatening the life or safety of people, we will report it to law enforcement authorities.

In-game items and currency

Resources, items, buildings, units and territory in the game are elements of the game, not your property. They have no monetary value, cannot be exchanged for money and no ownership right arises to them. All you acquire is the right to use them in the game for as long as your account exists.

Trading between players takes place solely for in-game resources and items. Selling in-game items or accounts for real money is prohibited and is grounds for blocking the account.

The game is developed continuously and its values are balanced as it goes. We may therefore change prices, yields, unit strength and other parameters. We only interfere with progress already made where it is necessary, and we announce significant changes in advance.

Intellectual property

The game, its graphics, texts, music, game mechanics, source code and the content of the website are protected by copyright and belong to the operator or to those who licensed them to us. Without our written consent you may not copy, modify, decompile or distribute them.

For playing itself we grant you a non-exclusive, non-transferable and revocable licence to use the game for personal, non-business purposes for as long as your account exists.

The icons in the game come from the game-icons.net library and are used in accordance with its licence. The map data is based on the OpenStreetMap project (© OpenStreetMap contributors, ODbL licence).

Content you create — your hero name, chat messages — stays yours. You grant us a royalty-free licence to it to the extent needed to run the game, that is, above all to display it to other players. The licence ends when the content is deleted; a chat message stays visible to others even after your account is deleted, but with no link to you as a person.

You are free to share screenshots and videos from the game, including streaming and videos carrying advertising.

Availability and changes to the game

Kokume is an online service under continuous development. We update, fix and extend the game; updates are part of the service and we recommend installing them, because older versions may stop working with the servers.

We do not guarantee uninterrupted availability. Service may be interrupted by maintenance, a hosting outage, a fault or circumstances beyond our control. We announce planned downtime in advance, in the game or on the website.

We may change the service unilaterally for a valid reason, meaning: balancing the game mechanics, safety and protection of players, technical development of the Android platform or of the technologies used, a change in legislation or a change in the cost of running the service. A change must not mean any additional cost for you.

If a change impairs your access to the game or your use of it other than merely negligibly, we will notify you by email a reasonable time in advance and you have the right to terminate the contract within 30 days of that notice, that is, to close your account with no penalty at all.

If we decide to shut the game down, we will announce it at least 60 days in advance and, during that time, let you download the content you created in the game.

Staying safe while playing outdoors

This game is played outdoors and on the move. Watch your surroundings, not just the screen.

Liability

We are responsible for the game working, for the duration of the contract, as described in these terms and in the game's description, and for damage we cause by breaching our obligations.

We are not liable for damage arising from circumstances beyond our control — in particular for the behaviour of other players, for your own movement in public space, for the GPS inaccuracy of your device, for an outage of your internet connection or for an event of force majeure.

Nothing in these terms limits liability for damage caused intentionally or by gross negligence, or liability for personal injury. Your statutory consumer rights remain fully preserved.

Defects in the service and complaints

If the game does not work as it should, tell us at info@kokume.eu at any time during the contract. Describe what is happening, on what phone and since when — a screenshot helps too.

We will acknowledge the complaint and handle it without undue delay, within 30 days at the latest. We will remove the defect within a reasonable time; if we do not manage to, you can withdraw from the contract. Because the service is free of charge, no right to a discount arises.

We cannot be responsible for a malfunction caused by your device not meeting the requirements set out above, which we told you about beforehand.

Ending the contract

You can end the contract at any time, without giving a reason and with no notice period — by deleting your account in the game under Settings or through the form on the website.

We may terminate the contract or close an account on these grounds:

Except where immediate action is necessary because a breach of the rules or of the law is under way, we will warn you before closing your account. We will always tell you the reason, and you can challenge it within 30 days by the procedure described in the moderation section.

When the contract ends, your game progress and your licence to use the game cease. What happens to your data after the account is closed is described in the privacy policy.

Changes to these terms

We may change these terms for the same valid reasons that apply to changing the service: development of the game and its features, safety, technical development of the technologies used and changes in legislation. That defines the scope of possible changes — we will not change the terms unilaterally on any other basis.

We will notify you of a change at least 30 days before it takes effect, by email and by a notice in the game when you sign in. If you do not agree with the change, you can terminate the contract by closing your account up to the day it takes effect; until then the existing wording applies. By continuing to play after the effective date you accept the change.

Every wording has its version number and effective date stated at the top. We keep a record of the version you agreed to. You can ask for a previous wording at info@kokume.eu.

Resolving disputes

The fastest route runs through info@kokume.eu — most misunderstandings we can clear up right away.

If we do not reach an agreement, you have the right as a consumer to out-of-court resolution of a consumer dispute. The competent body is the Czech Trade Inspection Authority (Česká obchodní inspekce), Central Inspectorate – ADR Department, Gorazdova 1969/24, 120 00 Prague 2, coi.gov.cz. The proceedings are opened at your request and are free of charge for you.

The Czech authority supervising consumer protection is the Czech Trade Inspection Authority (Česká obchodní inspekce); supervision of personal data protection is carried out by the Office for Personal Data Protection (Úřad pro ochranu osobních údajů). This does not affect your right to go to court.

Governing law and jurisdiction

The contract and these terms are governed by Czech law, in particular the Czech Civil Code (Act No. 89/2012 Coll.).

If your habitual residence is in another European Union country, the choice of Czech law does not deprive you of the protection afforded by the mandatory provisions of the law of your country of residence — those always apply to you where they are more favourable to you.

As a consumer you may sue either in the court of your place of residence or in the court of our registered office. We may sue you only in the court having jurisdiction at your place of residence.

The postal address is the same as the registered office given in the first section of these terms.

Final provisions

If any provision of these terms turns out to be invalid or ineffective, the remaining provisions stay valid and the invalid one is replaced by the statutory rule closest to it.

The privacy policy forms an integral part of this contractual relationship.

These terms take effect on the date stated in their heading and replace all previous wordings.
